Welcome to My Forex Freedom (“Company,” “we,” “us,” or “our”). By accessing or using any part of our website, services, software, or affiliate program (collectively, the “Platform”), you (“User,” “Affiliate,” or “Customer”) agree to comply with and be bound by these Terms of Use & Affiliate Agreement (“Terms”). If you do not agree, do not use the Platform.

1. Purpose and Scope

These Terms govern your use of all Company services, including but not limited to software tools, automation systems, educational materials, affiliate activities, and any paid features. They apply to both users and affiliates of My Forex Freedom.

For information about earnings, results, or performance claims, please review our Income Disclosure Statement, which is incorporated herein by reference.

2. Account Registration and Eligibility

You must be at least 18 years old to use the Platform. You agree that all information provided is accurate and that you will maintain confidentiality of your login credentials. We reserve the right to refuse, suspend, or terminate access to the Platform at our sole discretion, with or without notice.

3. Pricing, Fees, and Billing

By using our paid services, you agree to the current pricing structure as outlined below. Prices may change with notice.

3.1 Subscription Fees

Access to My Forex Freedom tools and systems may require a subscription fee, billed monthly or annually. Subscription tiers and benefits are detailed on our website or checkout pages.

3.3 Billing and Refunds

All usage charges are automatically billed to your payment method on file. All payments are non-refundable unless explicitly stated otherwise. Subscriptions may be canceled at any time before the next billing cycle.

4. Independent Contractor Status

All affiliates and users promoting Company services do so strictly as independent contractors. Nothing in these Terms creates an employer-employee, partnership, joint venture, or agency relationship between you and My Forex Freedom. You have no authority to bind or represent the Company in any manner. You are responsible for all applicable taxes, licenses, insurance, and legal obligations arising from your earnings.

5. Affiliate Program Participation

5.1 Affiliate Conduct

Affiliates agree to market ethically and lawfully. You may promote My Forex Freedom using approved materials, provided you:

• Do not make any guarantee of earnings, profits, or returns
• Do not use statements like “risk-free,” “guaranteed profits,” “double your money,” or similar claims
• Do not misrepresent My Forex Freedom as a broker, financial advisor, or investment manager
• Do not present your personal results as typical or guaranteed
• Mandatory Trading Risk Disclaimer: ⚠️ Past performance does not guarantee future results. Trading involves risk. Only trade with money you can afford to lose.

Affiliates must include this disclaimer clearly and visibly on all promotional materials, advertisements, emails, landing pages, videos, and social media posts related to My Forex Freedom or any trading-related content.

• Do not spam, deceive, or mislead prospects through false scarcity or high-pressure tactics
• Comply with all applicable laws, including FTC and CAN-SPAM regulations

5.2 Claim Approval and Oversight

Any advertisement, landing page, email, webinar, or promotional material that references earnings or performance must be reviewed and approved by the Company before use. The Company reserves the right to monitor, audit, or demand modification or removal of any promotional content at any time.

5.3 Commission Payments

• Commissions are earned only on valid, approved conversions tracked via your affiliate ID.
• Commissions are based on net sales (after refunds, chargebacks, and taxes).
• Payments may be held for up to 30–90 days to allow for refund and verification periods.
• The Company may withhold, reduce, revoke, or claw back commissions in cases of fraud, chargebacks, policy violations, or misleading promotions.
• Commission disputes must be raised within 30 days of payment; otherwise, they are waived.

5.4 Termination and Forfeiture

We may suspend or terminate your affiliate account immediately for non-compliance or unethical conduct. Upon termination, all unpaid commissions may be forfeited at our discretion.

6. Indemnification

You agree to indemnify, defend, and hold harmless My Forex Freedom, its officers, directors, employees, affiliates, successors, and assigns from all claims, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

• Any false, misleading, or unapproved statements made by you
• Violation of laws, regulations, or these Terms
• Misuse of Company materials, trademarks, or data
• Breach of confidentiality or intellectual property rights

This clause survives termination of your account.

7. Limitation of Liability

To the fullest extent permitted by law, My Forex Freedom’s total liability for any claim arising out of or relating to these Terms shall not exceed the total fees or commissions paid to you during the six (6) months prior to the incident giving rise to the claim. In no event shall My Forex Freedom be liable for any indirect, incidental, punitive, consequential, or special damages, including but not limited to loss of profits, data, business, or goodwill, even if advised of such possibility.

8. Risk and Financial Disclaimer

The Platform provides educational information and software tools only. We do not provide financial, legal, or investment advice. Trading and investing involve substantial risk, including loss of principal. Past performance does not guarantee future results. 9. Intellectual Property

All software, content, and materials on the Platform are owned or licensed by My Forex Freedom. You may not reproduce, copy, or distribute any part of the Platform without prior written consent. Affiliates may use Company trademarks and logos only in approved marketing contexts and may not alter or imply ownership.

10. Confidentiality

Any non-public information obtained through the Company must be kept confidential and not used except for authorized promotional activities. You must not disclose customer lists, pricing structures, or internal data.

11. Updates and Modifications

The Company may modify these Terms at any time. Updates will be posted on this page and effective immediately upon posting. Continued use of the Platform or participation in the affiliate program constitutes acceptance of any modifications.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Michigan, specifically Wayne County. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Wayne County, Michigan, for any dispute arising under or related to these Terms. If any provision is held unenforceable, the remaining provisions shall remain in full effect.

13. Entire Agreement

These Terms, along with any policies referenced herein (including the Income Disclosure), represent the entire understanding between you and My Forex Freedom, superseding all prior agreements or representations.
